We do not guarantee:

  • Employment, freelance work, or income

  • Skill acquisition at any specific level

Your outcomes depend entirely on your own effort, experience, and circumstances.

This is a non exhaustive list of we do not guarantee any form of future employment or work experience.

 

4. Intellectual Property

All content on the Website and within courses (including videos, text, graphics, templates, downloads, and methodologies) is owned by or licensed to Motion by Scott.

You are granted a limited, non-exclusive, non-transferable licence for personal use only.

You must not:

  • Share access to your account

  • Copy, reproduce, resell, or distribute content

  • Make course materials available to others

Violation may result in immediate termination without refund.

 

5. Payments & Access

Payments for courses, memberships, and digital products offered through Motion by Scott are processed via third-party payment providers, including but not limited to:

  • Stripe

  • PayPal

  • Lemon Squeezy

  • Kajabi Payments

We do not store or process your full payment card details directly. Payment information is handled securely by the relevant payment processor in accordance with their own terms, privacy policies, and security standards.

By making a purchase, you agree to comply with the terms and conditions of the applicable payment provider in addition to these Terms.

Access to digital content is typically granted immediately upon successful payment, unless otherwise stated at the point of purchase. You are responsible for ensuring that your device, software, and internet connection are compatible with the Services.

If a payment fails, is reversed, charged back, or disputed, we reserve the right to:

  • Suspend or revoke access to the purchased content

  • Require re-payment before restoring access

  • Investigate potential misuse or fraud

Nothing in this section affects your statutory rights under UK consumer law.

 

6. Refunds, Cancellations & Digital Content (UK & EU Compliance)

6.1 Statutory 14-Day Right to Cancel

If you are a consumer located in the UK or European Union, you have a legal right to cancel your purchase within 14 days of the purchase date, in accordance with the Consumer Contracts Regulations 2013 and EU consumer law.

To exercise this right, you must notify us clearly (for example, by email) within the 14-day period.

 

6.2 Digital Content & Immediate Access

Where you purchase digital content (including online courses and downloadable materials) and request immediate access, you acknowledge that access to the content begins straight away after purchase.

Normally, once access to digital content begins, the statutory right to cancel is lost under UK and EU law.
However, Motion by Scott provides a voluntary money-back guarantee, as set out below.

 

6.3 14-Day Money-Back Guarantee (25% Completion Limit)

In addition to your statutory rights, we offer a 14-day money-back guarantee for courses, subject to the following conditions:

To be eligible for a refund:

  • Your request must be made within 14 days of the purchase date

  • You must have completed no more than 25% of the course content

  • You must submit your refund request via email, clearly identifying your purchase

This guarantee exists to allow you to fairly evaluate whether the course is right for you, while preventing misuse of the refund policy.

 

6.4 Effect of a Refund

If a refund is approved:

  • You will be fully withdrawn from the course

  • Your access to all course materials, downloads, and communities will be immediately revoked

  • Refunds will be issued to the original payment method

 

6.5 Refunds Outside These Conditions

Refund requests that:

  • Are made after 14 days, or

  • Exceed the 25% completion threshold

may be declined at our sole discretion, unless required otherwise by law (for example, where digital content is faulty).

 

6.6 Statutory Rights Preserved

Nothing in these Terms limits or excludes your statutory rights under UK or EU consumer protection law, including rights relating to faulty digital content or misrepresentation.

 

7. LIMITATION OF LIABILITY

7.1 Excluded Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

IN NO EVENT SHALL MOTION BY SCOTT, ITS OWNER(S), OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY:

  • INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES

  • LOSS OF PROFITS, INCOME, REVENUE, OR ANTICIPATED SAVINGS

  • LOSS OF BUSINESS, CONTRACTS, CLIENTS, OR OPPORTUNITIES

  • LOSS OF DATA, INFORMATION, OR GOODWILL

  • REPUTATIONAL DAMAGE

  • WASTED EXPENDITURE OR EXPECTED BENEFITS

WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY, OR OTHERWISE, AND WHETHER OR NOT SUCH LOSS WAS FORESEEABLE OR WE WERE ADVISED OF THE POSSIBILITY.

 

7.2 Overall Liability Cap

TO THE FULLEST EXTENT PERMITTED BY LAW, AND NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS:

The total aggregate liability of Motion by Scott for any and all claims arising out of or in connection with the Services shall not exceed the total amount paid by you for the specific course or product giving rise to the claim.

This includes claims for:

  • Refunds

  • Defective content

  • Dissatisfaction

  • Alleged misrepresentation

 

7.3 Mandatory Legal Exceptions (UK)

Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot legally be excluded under UK law

 

 

8. No Warranty

All Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose.

 

9. User Conduct

You must not use the Website:

  • Unlawfully or fraudulently
